Terms and Conditions of Jet's Tours and Travel
1. Definitions
1.1 Contractor: Jet’s Tour and Travel, registered with the Chamber of Commerce under registration number: 94192731, located at Vierlinghlaan 126, 2332CX in Leiden.
1.2 Client: The individual or entity utilizing the services of the Contractor.
1.3 Activity(ies): The advising and mediating of Services by the Contractor on behalf of the Client.
1.4 Service(s): The travel experiences, excursions, and other related services advised and/or mediated by the Contractor.
2. Applicability
2.1 These terms and conditions apply to all offers, agreements, and deliveries of the Activities of the Contractor.
2.2 By using the Activities of the Contractor, the Client accepts these terms and conditions.
3. Services
3.1 The Contractor advises activities based on their own positive experiences and previously conducted Activities.
3.2 The Contractor utilizes third parties for the execution of its activities.
3.3 The Contractor acts as an independent advisor or mediator concerning the Services sought and requested by the Client. The Contractor has no obligations, nor does the Contractor receive financial benefits, in performing its activities concerning the providers of the Services.
4. Liability
4.1 The Contractor is not liable for any damage, loss, or injury arising from or related to its Activities or Services obtained by the Client from third parties.
4.2 Participation in Services is entirely at the Client's own risk. Therefore, the Client is advised to follow all instructions from the service provider(s) at all times.
4.3 The Contractor is not liable for errors, omissions, or other shortcomings or cancellations, whether intentional or unintentional, of third parties providing the Services.
4.4 The Contractor emphasizes that only a duty of effort applies to its Activities, not a duty of result. The Activities performed are shaped to the best of the Contractor’s understanding based on the needs of the Client. The Client's personal experience during the execution of the final Services is subjective and can depend on personal taste, weather conditions, or other external factors.
5. Responsibilities of the Client
5.1 The Client must inform themselves about the nature of the activities and the associated risks.
5.2 The Client is responsible for taking out adequate travel and cancellation insurance.
5.3 The Client is responsible for adhering to all instructions and safety regulations provided by the service providers.
6. Bookings and Payments
6.1 Orders for the Contractor must be paid in advance according to the terms established upon order confirmation.
7. Complaints and Disputes
7.1 Complaints about the services advised or mediated by the Contractor must be submitted in writing within 14 days after the end of the activity.
7.2 Disputes arising from or related to these terms and conditions will be exclusively submitted to the competent court in the Netherlands.
8. Force Majeure
8.1 The Contractor is not liable for delays or failures in the performance of its obligations if caused by circumstances beyond its reasonable control, including but not limited to natural disasters, war, strikes, and government actions.
9. Changes to the Terms and Conditions
9.1 The Contractor reserves the right to change these terms and conditions at any time.
9.2 Changes will be communicated to the Client in writing and will take effect 30 days after the announcement.
